On Monday a judge postponed setting the preliminary hearing for
a suspect shot in an altercation with a university police officer
in Kerckhoff Hall on Oct. 5.
John Raphling, public defender for suspect Willie Davis Frazier,
said he needs additional documents from university police before
going to trial.
Raphling did not specify what types of documents he is
requesting but said university officials “appear to be
opposing my request.”
A judge will decide at a Dec. 18 hearing what documents
university police must give to the defense.
Deputy District Attorney Frank Tavelman said the prosecution is
ready to proceed with the preliminary hearing.
Tavelman and Raphling will meet again at a hearing Dec. 12 to
discuss, in part, whether Raphling needs more documents from
Tavelman’s office.
The delay marked the third time a preliminary hearing for
Frazier has been postponed. All were due to defense requests for
more information.
Police accounts state that UCPD officer Terrence Duren
confronted Willie Davis Frazier, who was trespassing in Kerckhoff
Hall, on Oct. 5.
A physical confrontation ensued, and Duren, reportedly in fear
for his life, shot Frazier.
Frazier has been incarcerated since Oct. 11 and pleaded not
guilty to two counts of assault and one count of removing an
officer’s weapon.
Duren was placed on administrative leave after the incident but
has since then returned to active duty.
