The Supreme Court may soon be requested to rule on same-sex marriage, after an appeals court ruled today that denying benefits for same-sex couples is unconstitutional.
A three-judge panel of the 1st U.S. District Court of Appeals in Boston ruled that the Defense of Marriage Act deprives gay couples the rights and privileges that are granted to heterosexual couples. The decision is the latest in a yearlong battle surrounding the controversial 1996 law.
A recent Daily Bruin article reported on a separate judicial case that is expected to be heard by an appeals court in September.
That case, which originated in California, deals primarily with the question of whether same-sex spouses of federal employees can be prohibited from receiving federal health care plans typically awarded to heterosexual couples.
