Veto of SB 185 leaves admissions questions to California court system

Gov. Jerry Brown on Saturday vetoed a measure that would have allowed race, ethnicity and gender to be considered in University of California admissions, saying such a decision should be left to the court system.

Brown said in his veto message that he “wholeheartedly agrees” with the measure, SB 185, proposed by Senator Ed Hernandez (D-West Covina).

But he said interpretation of 1996 voter-approved measure Proposition 209 should be handled by the California court system. Prop. 209 prohibits the state from discriminating or helping individuals on the basis of their gender, race or ethnicity for admission or employment to public institutions.

“Our constitutional system … requires that the courts ““ not the Legislature ““ determine the limits of Prop. 209,” Brown said in the veto message.
